Regulations of the Online Store and Provision of Services by Electronic Means

1. General provisions

1.1. The Online Store available at the internet address rainbowgifts.pl is run by Pixel of Art. Grzegorz Mendak is headquartered at ul. Główna 29, 97-318 Czarnocin; NIP: 731-144-09-40; REGON: 369253011, e-mail address: office@pixelofart.com, hereinafter referred to as Pixelofart.
1.2. These Regulations are addressed to both consumers and entrepreneurs using the Online Store, unless the content of the Regulations clearly states that its specific provision applies either only to consumers or only to entrepreneurs.

1.3. These regulations include the provisions regarding the sale of products made via the online store at the address by Pixelofart, the provision of the design and print service and the provision of the service consisting in intermediation in the placing on the market of word-graphic or graphic works from the Authors in the form of their published copies (including in especially printed) on products offered in the online store by Pixelofart.
1.4. The administrator of personal data processed in connection with the implementation of the provisions of these Regulations is Pixel of art. Providing personal information is voluntary. Any person whose personal data is processed by the Service Provider or the Administrator has the right to inspect their content and the right to update and correct them.

1.5. The data controller processes the following data:

in the case of Buyers who are natural persons: name, surname, address for service, e-mail address, contact telephone number

in the case of Creators: specified in detail in the regulations

1.6. Before creating an account, the user agrees to the collection and processing of personal data in accordance with the regulations that read: "I consent to the collection of my personal data contained in the registration form in order to make purchases and use the services of the Online Store"

2. Definitions

2.1. WORKING DAY - one day from Monday to Friday, excluding public holidays.
2.2. REGISTRATION FORM - a form available in the Online Store that allows you to create a User Account
2.3. ORDER FORM - Electronic Service, an interactive form available in the Online Store that allows placing an Order, in particular by adding Products to the electronic basket and defining the terms of the Sales Agreement, including the method of delivery and payment.
2.4. BUYER - (1) a natural person with full legal capacity, and in cases provided for by generally applicable regulations also a natural person with limited legal capacity; (2) legal person; or (3) an organizational unit without legal personality, which the law recognizes as having legal capacity; - who has concluded or intends to conclude a Sales Agreement with the Seller.

2.5. CREATOR - a natural person with full legal capacity or a person with limited legal capacity acting through their statutory representatives (parents, guardians), who creates graphic or word-graphic works and offers them for marketing through the Pixelofart online store or intends to to offer them this way.

2.6. USER - Buyer or Creator.
2.7 ACCOUNT - Electronic Service, marked with an individual name (login) and password provided by the User, constituting a set of data stored, processed and made available to the User in the Pixelofart ICT system, in which the data provided by the Service User and information about Orders placed by him in the Online Store are collected or the songs he offers.

2.8. PRODUCT - a movable item available in the Online Store that is the subject of the Sales Agreement between the Customer and the Seller, in particular in the form of t-shirts, mugs, bags, sweatshirts, phone cases.
2.9. REGULATIONS - these regulations of the Online Store and the Provision of Services by Electronic Means.
2.10. ONLINE STORE - Pixelofart online store available at the Internet address: www.pixelofart.com
2.11. SERVICE PROVIDER or SELLER - Pixelofart.
2.12. SALES AGREEMENT - a Product sales agreement concluded or concluded between the Buyer and Pixelofart via the Online Store.

2.13. Intermediation AGREEMENT - an agreement for intermediation in the marketing of copies of graphic or word-graphic works of the Artists placed on the products offered by Pixelofart.
2.14. . ORDER - Buyer's declaration of will submitted via the Order Form and aimed directly at concluding a Product Sales Agreement with the Seller.

2.15. PERMISSIBLE CONTENT - it is forbidden to distribute any illegal content via the Online Store, even for personal use, the following content in particular is considered illegal:
